Jimmy Lai, a former Hong Kong media magnate known for his pro-democracy stance and criticism of Beijing, has been handed a 20-year prison sentence in a high-profile case brought under a national security law imposed by China, effectively stifling dissent in the city. Judge Esther Toh ruled that 18 years of Lai’s sentence would run consecutively with his existing jail time for a fraud conviction, totaling five years and nine months. Lai retains the option to appeal the verdict. His co-defendants, including six ex-staff members of his Apple Daily newspaper and two activists, were also sentenced to prison terms ranging from 6¼ to 10 years on charges related to collusion.

Despite facing serious accusations such as conspiring with foreign forces to undermine national security and publishing seditious materials, Lai, aged 78, was spared a life sentence by three judges appointed by the government. Lai’s conviction in December means that even with his age, the cumulative jail time could effectively mean life imprisonment. The sentencing of Lai has the potential to escalate diplomatic tensions between Beijing and foreign nations, drawing widespread criticism globally.

Various international figures, including U.S. Secretary of State Marco Rubio and Canadian Foreign Affairs Minister Anita Anand, have expressed concern over Lai’s harsh sentence and have called for his release on humanitarian grounds. Rubio highlighted the message the sentence sends about Beijing’s suppression of fundamental freedoms in Hong Kong. Anand emphasized Canada’s disappointment with the outcome and reiterated support for independent media worldwide.

Lai’s legal team has raised concerns about his health, citing issues like heart palpitations, high blood pressure, and diabetes. His son, Sebastien, described the prison term as “draconian” and life-threatening for his father, labeling it as a blow to the Hong Kong legal system and justice. Despite the severity of the sentence, Lai’s family remains resolute, with Sebastien emphasizing that China may have imprisoned his father physically, but not his spirit, as evidenced by Lai’s defiant demeanor during the sentencing.

Lai’s trial has underscored fears about diminishing press freedom in Hong Kong, once considered a stronghold of media independence in Asia. The Chinese government has maintained that the case is not about press freedom but rather about individuals misusing journalism to harm China and Hong Kong. Lai’s arrest in 2020 was a significant early action under the national security law, leading to further arrests of senior journalists at Apple Daily and the eventual closure of the publication in 2021.

The international community has strongly condemned Lai’s sentencing, with the UK Foreign Secretary and the Inter-Parliamentary Alliance on China calling it a politically motivated attack on freedom of expression. The European Union has urged Lai’s immediate release citing his age and health, while Amnesty International has criticized the sentence as a grave violation of human rights. In response, China’s Foreign Ministry has asserted that the cases are internal matters for Hong Kong, urging foreign entities to refrain from interfering in judicial affairs. The Ministry also accused Lai of orchestrating anti-China activities in Hong Kong.
