Former FBI chief James Comey faced a new indictment on Tuesday related to an investigation into a social media image showing seashells arranged on a beach, which authorities claimed posed a threat to President Donald Trump. This marks the second legal action against Comey in recent times, part of the Trump administration’s persistent campaign to prosecute political adversaries. The photo of seashells was originally posted almost a year ago, but the charges were brought forth by acting U.S. Attorney General Todd Blanche, a Trump loyalist aiming to demonstrate his suitability for the permanent role.
The indictment accuses Comey of intentionally making a threat against President Trump’s life and safety, as well as transmitting this threat via interstate communication. Despite lacking concrete evidence supporting the allegation, the indictment implies that a reasonable observer familiar with the context could interpret the message as a threat. During a press conference announcing the indictment, Blanche declined to provide specifics on the evidence of intent but emphasized the methods typically used to establish intent in legal cases.
In response to criticisms of selective prosecution, Blanche asserted that the charges against Comey were consistent with the department’s approach to handling similar threat cases involving lesser-known individuals. Comey, in a video message shared on his substack page, maintained his innocence and confidence in the judicial system. He expressed disappointment in the Department of Justice’s actions, urging the public to maintain faith in the system.
The legal proceedings were initiated in the Eastern District of North Carolina, where Comey encountered the seashells. The controversy stemmed from an Instagram post made by Comey in May, showcasing seashells arranged in the pattern “86 47.” While Comey clarified that he perceived the numbers as a political statement rather than a call for violence, the Secret Service swiftly questioned him following claims by Trump officials alleging an assassination inference.
According to Merriam-Webster, “86” signifies getting rid of or refusing service. Trump, in a Fox News interview, accused Comey of understanding the implied threat in the numbers. The former FBI director had been previously indicted in September for allegedly providing false information to Congress, a case that was later dismissed due to procedural irregularities.
Comey, appointed as FBI director under President Barack Obama’s administration, had a strained relationship with Trump, culminating in his dismissal in 2017 amid investigations into Russian interference in the U.S. election. The ongoing legal battles against Comey are part of a broader pattern of politically charged prosecutions initiated by the current Justice Department leadership.
The department has also targeted other prominent figures like former CIA director John Brennan as part of its efforts to address grievances related to the Russia investigation. Despite the legal pressure, Comey and other Trump critics remain steadfast in defending their actions and asserting their innocence.
