A property developer, who previously advised Peguis First Nation and its real estate trust, has acquired the majority of a former golf course located north of Winnipeg. The purchase was made possible using funds received by Peguis as reparation for unfulfilled treaty commitments. The transfer of ownership has raised concerns among legal experts and the band’s lawyer, citing the transaction as atypical. The Peguis First Nation Real Estate Trust sold a significant portion of the Meadows Golf Course to the developer on November 22, 2024, to alleviate financial strains.

The original acquisition of the 181-acre property in 2021 utilized $10 million of treaty land entitlement funds, with the remainder covered by a $5.5-million loan from a company owned by Maureen Diamond, the developer’s spouse. Following financial challenges, the trust defaulted on payments, resulting in the recent transaction. The agreement stipulates that the developer will repay the trust $10 million over a seven-year period, with an interest rate linked to the Bank of Canada bond benchmark.

The deal grants the developer control over developing a residential neighborhood on the land, while the trust retains ownership of a portion, including a daycare facility and additional land segments. Despite legal actions initiated by Peguis against the developer, the transaction proceeded, leaving the trust without immediate compensation. The developer’s lawyer defended the transaction as standard practice, emphasizing the benefits for the trust in recouping its initial investment and debt relief.

Former trust officials expressed that the transaction was necessitated by financial constraints and external pressures, leading to limited options. The sale faced opposition from within the community, with concerns raised over the loss of Indigenous-owned land and control in the development process. Legal experts highlighted the complexities of the agreement, questioning the fairness and transparency of the deal. The intricacies of the transaction and the involvement of various entities have sparked debates about the handling of treaty entitlement funds and land ownership within the Indigenous community.
