A jury in the United States decided against Elon Musk in his legal battle with OpenAI, concluding that the artificial intelligence firm was not responsible to the billionaire for allegedly deviating from its original objective of benefiting humanity. The verdict was unanimous and delivered swiftly in an Oakland, California federal court, with the jury determining that Musk’s lawsuit was filed too late. The case was viewed as pivotal for the future direction of OpenAI and the broader landscape of artificial intelligence, raising questions about its ethical use and who should reap its rewards. In Musk’s 2024 lawsuit, he accused OpenAI, along with its CEO Sam Altman and President Greg Brockman, of deceiving him into providing $38 million before transitioning from a non-profit to a for-profit model and securing significant investments from entities like Microsoft. Musk condemned the actions of the OpenAI defendants as akin to “stealing from a charity.” Founded in 2015 by Altman, Musk, and others, OpenAI saw Musk leave its board in 2018, after which the organization pivoted to establish a for-profit arm.

The trial, spanning 11 days with testimonies and arguments, witnessed attacks on the credibility of Musk and Altman from both sides. Musk’s legal team underscored doubts concerning Altman’s honesty and trustworthiness, emphasizing their importance in the case’s outcome. Musk asserted that OpenAI was primarily focused on enriching investors at the expense of its non-profit mission and neglected the safety aspects of AI. Conversely, OpenAI contended that Musk delayed in accusing them of breaching their commitment to developing safe AI for societal benefit.

The rivalry between Musk’s xAI and OpenAI, alongside their potential public offerings with substantial valuations, underscores the fierce competition in the AI sector. Microsoft’s substantial investments in OpenAI further underscore the significant stakes involved in shaping the future of artificial intelligence. Musk’s xAI venture has now become part of SpaceX, his aerospace company, which is also gearing up for a sizable IPO that could surpass the valuation of OpenAI.
